การแบ่งแยกประเทศนั้นถือเป็นกบฏต่อแผ่นดินชัดเจนและขัดต่อรัฐธรรมนูญมาตรา 1 ที่บัญญัติว่า “ประเทศไทยเป็นราชอาณาจักรอันหนึ่งอันเดียวจะแบ่งแยกมิได้” รวมทั้งขัดมาตรา 68 ซึ่งมีสาระสำคัญว่า บุคคลใดจะใช้สิทธิและเสรีภาพตามรัฐธรรมนูญเพื่อล้มล้างการปกครองระบอบประชาธิปไตยอันมีพระมหากษัตริย์ทรงเป็นประมุขหรือให้ได้มาซึ่งอำนาจในการปกครองโดยวิธีการซึ่งมิได้เป็นไปตามวิถีทางที่บัญญัติไว้ในรัฐธรรมนูญมิได้ ซึ่งโทษสำหรับผู้กระทำผิดตามมาตรา 68 นอกจากโทษทางอาญาแล้ว ผู้ร้องอาจยื่นเรื่องให้ศาลรัฐธรรมนูญวินิจฉัยยุบพรรคการเมือง ซึ่งหากศาลรัฐธรรมนูญสั่งยุบพรรคก็จะเพิกถอนสิทธิเลือกตั้งหัวหน้าพรรคและคณะกรรมการบริหารพรรคนั้นเป็นเวลา 5 ปีด้วย
พรรคเพื่อไทยนั้นส่อพฤติการณ์เป็นกบฏแบ่งแยกประเทศและขัดรัฐธรรมนูญมาตรา 68โดยมี นายจารุพงศ์ และพะเยาโมเดลเป็นใบเสร็จมัด
แต่ที่น่าประแปลกใจก็คือ ทั้งๆที่มีขบวนการคิดกบฏแบ่งแยกประเทศอย่างชัดเจนซึ่งเป็นภัยร้ายแรงต่อความมั่นคงของชาติ แต่หน่วยงานด้านความมั่นคงโดยเฉพาะกองทัพกับตำรวจกลับเกียร์ว่างเฉยเป็นสากกะเบือเหมือนไม่มีอะไรเกิดขึ้น ซึ่งเข้าข่ายละเว้นการปฏิบัติหน้าที่หรืออาจถูกตั้งข้อสงสัยได้ว่ารู้เห็นกับขบวนการคิดกบฏแบ่งแยกประเทศ
