พล.ต.อ.วสิษฐ เดชกุญชร อดีตรองอธิบดีกรมตำรวจ เรียกร้องให้สำนักงานตำรวจแห่งชาติสอบสวนและชี้แจงข้อเท็จจริงกรณีคนชุดดำอยู่บนตึกสูงภายในสนามกีฬาไทย-ญี่ปุ่นดินแดงซึ่งอยู่ในการควบคุมของฝ่ายตำรวจแล้วใช้ปืนยิงเข้าใส่ประชาชนด้วยกระสุนจริง

ข้อน่าสงสัยอีกกรณีหนึ่งก็คือการที่ประชาชนผู้ชุมนุมพบคนชุดดำที่สวมรอยปะปนอยู่ในกลุ่มผู้ชุมนุมแล้วพยายามใช้ปืนยิงใส่ประชาชน ซึ่งการ์ดของประชาชนเห็นเข้าพอดีจึงไล่กวดแต่ชายชุดดำดังกล่าววิ่งหลบหนีไปโดยทิ้งกุญแจมือไว้เป็นหลักฐานทำให้น่าสงสัยว่าจะเป็นคนในเครื่องแบบ
